The agreement
These terms are an agreement between you and Avksoft Ltd (“we”, “us”) for your use of Smartplannr. We are a company registered in England and Wales with company number 11651209. By creating an account you accept these terms. If you use Smartplannr for a company, you confirm you are allowed to accept them on its behalf. Our Privacy policy explains how we handle your data.
What Smartplannr does
Smartplannr lets you write social media posts, tailor them for each network, schedule them and have them published to the accounts you connect, then read the comments and the metrics the networks report.
The AI writer drafts, rewrites and translates text for you. AI output can contain mistakes, so check it before you publish. Analytics and reports show what each network reports: we don’t estimate missing figures, and we can’t guarantee that a network’s own figures are accurate.
Your account
You need to be at least 18 to use Smartplannr. Keep your password safe; you are responsible for what happens under your account. Tell us at hello@smartplannr.com if you think someone else has used it.
Workspaces and teams
Each workspace belongs to its owner. Owners and admins decide who is invited and with which role, and are responsible for what members do there, so only invite people you trust. An agency workspace can hold client workspaces; clients you invite see what you send them for review.
If you join someone else’s workspace, its owner is in charge of it: the content you add stays there if you leave or are removed.
Your content
You own the posts, media and other content you create in Smartplannr. You give us permission to store, process, copy and send it only as needed to run Smartplannr for you, including publishing it to the networks you choose and using the providers listed in our Privacy policy.
You confirm you have the rights to everything you upload and publish, including other people’s images, voices, music and trademarks in it.
Connected networks
Publishing, comments and analytics depend on each network’s API. Each network’s own terms and policies apply to what you publish there, and a network can change, limit or withdraw access at any time.
We retry temporary failures and tell you when a post can’t be published and why, but we can’t guarantee that a network will accept every post or publish it at an exact minute. Some networks need reconnecting from time to time; LinkedIn, for example, every 60 days.
Automatic posting to X is included on Pro and Max, up to each plan’s monthly allowance, for posts without a link. On Starter and Plus, for posts with a link, and beyond that allowance, X posts are handed to you as a ready-to-post link to share yourself.
Smartplannr uses YouTube API Services. By connecting a YouTube channel to Smartplannr you agree to be bound by the YouTube Terms of Service.
Acceptable use
Don’t use Smartplannr to:
- publish anything illegal, misleading or hateful, spam, or content that infringes someone else’s rights;
- harass, deceive or harm others, or publish content that sexualises minors;
- break the rules or rate limits of a connected network, or fake engagement;
- break, overload or get around the limits of the service, or access workspaces that aren’t yours;
- resell or share access to your account.
We may remove content or suspend accounts that break these rules.
Plans and payment
- Starter: free.
- Plus: £7 a month or £67 a year.
- Pro: £15 a month or £144 a year.
- Max: £35 a month or £336 a year.
What each plan includes is set out on our pricing page.
Paid plans are billed monthly or yearly in advance through Stripe, in pounds sterling. We are not registered for VAT, so no VAT is added: the price shown is the price you pay. If your card is in another currency, your bank may add a conversion fee. You can cancel at any time from your billing settings; your plan stays active until the end of the period you paid for, then moves to Starter. If a payment fails, Stripe retries it, and your plan stays active until the end of the period you paid for; if it still hasn’t been paid by then, your workspace moves to Starter and nothing is deleted.
Your right to cancel: if you are a consumer, you can cancel a new paid plan within 14 days of buying it and get a refund. As you ask us to start the service straight away, the refund is reduced in proportion to the time your plan was active before you cancelled. To cancel, email hello@smartplannr.com within the 14 days and we will refund you within 14 days of hearing from you. After the 14 days, payments are not refunded for the rest of a billing period, unless the law requires it or the service was not as described.
We will tell you by email at least 30 days before a price change applies to you, so you can cancel before it does.
Changes and availability
We are improving Smartplannr all the time and may change or remove features. We aim to keep it running smoothly but can’t promise it will always be available or error-free. Smartplannr is not a backup service: keep your own copies of media you can’t replace. If we make a change to these terms that matters, we will tell you before it takes effect.
Ending the agreement
You can stop using Smartplannr at any time. To delete your account and the workspaces you own, email hello@smartplannr.com; a paid plan is cancelled when the account is deleted, without a refund for the rest of the period (apart from your 14-day right to cancel). We may suspend or close an account that breaks these terms, and we will tell you why unless the law prevents it.
Liability
We provide Smartplannr with reasonable care and skill. Beyond that, and to the extent the law allows, it is provided “as is”. We are not liable for losses that were not foreseeable, or for business losses such as lost revenue, profit, opportunities or followers. Our total liability to you is limited to the greater of £100 and what you paid us in the 12 months before the claim. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit, and nothing affects your statutory rights as a consumer, including under the Consumer Rights Act 2015.
Law and contact
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts. Please contact us first at hello@smartplannr.com so we can try to sort out any problem.
